TERMS AND CONDITIONS
It is agreed that the terms set out in this booking form is the total agreement made between the parties and that no variation or modification of this contract shall be effective unless agreed by both parties in writing. Emma Wright Photography is hereafter known as ‘the photographer’ for the purposes of this agreement.
Prior to booking Emma Wright as the photographer for your photoshoot, you have seen the photographer's portfolio and understand the style, grain & edit in which your images will be presented. Thus also corresponds with the type of session that you are booking with thew photographer.
RAW / unedited files are not available for viewing / and or inclusion in the final set of images, this includes those images that do not make the final set. The images selected for editing in the full gallery reflect the photographers high standards and are the only images retained in our archives.
Special Requests / Coverage: The client understands and accepts that the photographic coverage will be as the Photographer’s professional expertise determines and that no one photograph will be deemed more important than another. Special requests are not binding instruction, although every effort is made to comply with the client’s wishes.
Any special requests not notified on this booking form must be made by the client to the Photographer in writing
Images: The Photographer's judgement regarding the number of images edited and supplied shall be final, the photographer reserves the right to deal with requests for the supply of further images to be additional work. Images will be posed and edited to the style that of the photographers portfolio.
Retouching: The Photographer will use own judgement and taste in utilising minimal retouching and image manipulation where appropriate. The Photographer reserves the right to deal with specific requirements or requests for retouch amendments as additional work. The re-touch will be
Copyright: Any images or copies of images whether stored digitally or otherwise and any computer programme including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988. It is contrary to the Act to copy or allow to be copied photographically / electronically or by any other means an image created as part of this contract without permission of the Photographer in writing.
Digital Files: Digital files remain the property of the Photographer though a licence is granted to the client to use them for their own commercial website, social media platforms, print and digital marketing material, personal use and advertising platforms. The copying or distribution of files, images and discs outside of this licence is a contravention of copyright.
Licence: The photographer shall be granted complete artistic licence including in relation to the poses photographed and the locations used. The photographer’s judgement regarding location / poses and number of images taken and supplied shall be final. Due to the vagaries of the weather it may not be possible to capture all the images requested.
Force Majeure or Act of God: The Photographer shall not be liable for any failure or delay in the performance of any of such party’s obligations under these Terms caused by any circumstances beyond such party’s reasonable control.
Delivery of Images; Digital files will be delivered to the client via wetransfer. It is the clients responsibility to download and make their own secure-back up copies of the images on their own devices. If images are presented as a gallery for final images to be selected, the images will be presented in an online gallery with watermarks. It is the clients responsibility to select the previously agreed number of images within the outlined timeframe. The online gallery will be available for a limited time only, outlined upon delivery.
Display: The client hereby allows the photographer to display any images included in this contract in their studios, portfolios, literature, exhibitions, website, social media and advertising on all platforms including but not limited to digital and print platforms. No use of the images will be made by the photographer for other commercial reasons except with the written permission of the client.
Cancellation: The client may cancel this contract at any time by giving written notice to the photographer but in doing so shall forfeit any monies paid. If cancelling the shoot in advance of 7 days prior to the session and if the session can be resold then the client will be refunded 50% of the session fee and the remaining 50% deposit retained by the photographer can be re-scheduled to another agreed session date. In the event of the Client cancelling within 7 days of the session the photographer reserves the right to hold the entire session fee.
Payment is required in full to secure the clients booking. This includes a non-refundable deposit of 50%
In the case of a postponement, then subject to availability on a new date, monies other than the booking fee may be applied to the new shoot. It is agreed the shoot may be postponed due to inclement weather only on the agreement of both parties. If the photographer is forced to cancel the agreement then any fees and deposits will be reimbursed in full to the client.
Complaints: Any complaints should be raised by the client with the photographer in writing, within 28 day of first becoming aware of the matter to be complained of and in any event within 28 days of receipt of the images.
The photographer will make every effort to communicate and engage with all models on shoots to obtain images in line with her portfolio. On the occasion that the model(s), child or other person within the shoot does not participate as required by Emma Wright Photography or their parent/ guardian, no refund is available however a discounted additional photoshoot may, in certain circumstances, be offered.
Session timings are fixed upon booking, In every case the photographer will try to be as accommodation as possible but sessions start and end at booked times. The client should arrive at a session 15 minutes prior to the start time of the session to ensure that they are ready to begin at the booked time in a calm manor to achieve the best results.
